These Terms of Service ("Terms") govern your use of the services provided by JXC Marketing LLC ("we," "us," or "our"). By engaging our services, you agree to be bound by these Terms.
Services
JXC Marketing LLC provides marketing strategy, lead generation system design and build, and ongoing management services. We provide strategic guidance and hands-on management. We do not guarantee specific results, as outcomes depend on factors beyond our control.
No Guarantees
We do not guarantee specific results, outcomes, or performance metrics. Marketing results depend on numerous factors beyond our control, including market conditions, implementation quality, and business circumstances. Our role is to provide strategic guidance based on our experience and expertise.
Client Responsibilities
As a client, you agree to:
- Provide accurate and complete information about your business
- Respond to communications in a timely manner
- Make decisions and provide approvals as needed for the engagement
- Pay for services according to the agreed-upon terms
Payment Terms
Payment terms will be specified in your service agreement. All fees are due according to the payment schedule outlined in your agreement. We accept payment via Stripe.
Intellectual Property
Upon full payment, you will own the deliverables created specifically for your engagement. We retain ownership of our methodologies, frameworks, and any pre-existing intellectual property used in providing our services.
Confidentiality
We will maintain the confidentiality of your business information. We will not disclose your confidential information to third parties without your consent, except as required by law.
Limitation of Liability
Our liability to you for any claims arising from our services is limited to the total fees paid by you for those services. We are not liable for any indirect, incidental, special, consequential, or punitive damages, regardless of the cause of action.
Termination
Either party may terminate an ongoing engagement with 30 days' written notice. In the event of termination, you will be responsible for payment of all services rendered up to the termination date.
Governing Law
These Terms are governed by the laws of the State of Ohio, United States. Any disputes arising from these Terms or our services will be resolved in the courts of Ohio.
Changes to Terms
We may update these Terms from time to time. Updated Terms will be posted on this page with a new effective date. Continued use of our services after changes constitutes acceptance of the updated Terms.
